3. Purposes of processing and basis of legitimacy

(i) Management of purchases of products offered by AILIN, as well as the registration of your user account and the process of viewing the results of the tests contracted.

The basis of legitimacy is the execution of the terms and conditions of the AILIN Platform entered into between AILIN and the user, whereby “...".“it is necessary for the performance of a contract to which the data subject is a party or for the application of pre-contractual measures at his or her request”in accordance with Article 6.1.b) GDPR. No transfers of your personal data to countries outside the European Economic Area are envisaged.

These Terms and Conditions are binding on Users by the mere fact of accessing and/or using the Website and apply from the very first moment.   1. DEFINITIONS
    1. In order to facilitate the understanding of this document, the following terms shall have the definition set out below:
      1. Platform”Platform" shall mean the Website to which the User may access in order to make use of the services specified in these Terms and Conditions. 
      2. «Seller«Ailin shall be understood as the entity that markets the products and services of the Platform.
      3. «Buyer«shall be understood as any user/customer of the platform interested in carrying out a contracting process of the platform's products and services.
      4. «User Account«User Account shall mean the private area to which the User has access after registration as a User.
      5. User” o «Users«User shall mean any professional accessing and/or interacting with the Home Diagnostics Website.
      6. Report of results” o «Results«The term "Results" may refer to the Results Report that the User will receive after the analysis of the submitted sample by the health professional and that will be accessible through his/her User Account. 
      7. «Sample collection kit«Sample collection kit": means the set of instruments for the collection of biological samples that users will receive at their homes in order for Home Diagnostics to provide them with information regarding their state of health. 

  2. SERVICES
    1. Commercial transactions concluded through www.ailin.es between the Buyer and the Seller shall be governed by the following General Terms and Conditions. Acceptance of this document implies that the Buyer:
      • You have read, understand and comprehend the above.
      • That he/she is a person with sufficient capacity to contract.
      • That it assumes all the obligations set forth herein.
    2. The present conditions shall be valid for an indefinite period of time and shall be applicable to all purchases made through the Seller's website. The Seller reserves the right to unilaterally modify these Conditions, without this affecting the goods or promotions that were purchased prior to the modification.
    3. Home Diagnostics offers, through the Platform accessible from the Website, a service that allows the User to carry out control and monitoring of their physiological and pathological state. Users may purchase, through the web platform, a set of instruments for taking biological samples, which will be sent to their homes. The sampling instruments will be accompanied by an explanation on how to proceed with the sampling and a questionnaire to be completed by the User that will allow Home Diagnostics, if the customer so authorises, to interpret the result of the test. Once the sample has been taken by the User and sent to Home Diagnostics' partner laboratory for analysis, Home Diagnostics will provide the User with information on its platform about the result of the test and, if the User so authorises, will carry out a review of the results of the contracted test and comment on it by a team of healthcare professionals. 
    4. The User will receive a notification when the Results Report is available for consultation in his/her User Account. The Results Report will contain the information on their physiological and pathological status relating to the biological sample analysed, and will include a commentary with the overall analysis of the Results, a detailed explanation of each parameter analysed, as well as recommendations for improving personalised lifestyle habits. 
    5. The Results Report will be available as soon as possible. Home Diagnostics does not commit to providing Users with Results by a specific date, but most Results are available for consultation within 5 to 7 days.
    6. The Platform allows the User to monitor their health status by knowing their biomarkers, receiving personalised lifestyle recommendations, test reminders, anticipating risk factors based on surveys and the latest approved scientific guidelines. 
    7. The User must bear in mind that the results report prepared by Home Diagnostics will be limited to the scope of the sample sent by the User. Therefore, Home Diagnostics does not guarantee and is not responsible for not providing the User with information on those diseases or pathologies that could not be detected in the analysis of the sample taken by the User or on those that require specific studies or tests for their detection. 
    8. In any case, Reports of results provided by Home Diagnostics are issued for informational purposes only and cannot be considered as a medical consultation or diagnosis.Use of the Platform is not a substitute for appropriate medical advice from a health care professional. The User is advised to seek medical advice from their doctor for further health tests or examinations..
    9. In no case does the information provided by Home Diagnostics to Users imply the prescription, cancellation or modification of any medical treatment. The User understands that Home Diagnostics only provides information, recommendations and advice on healthy habits to Users based on the Results obtained.
    10. The Services may not be available at all times for the following reasons:
      1. Registration has not been effective.
      2. When Home Diagnostics has reason to believe that the User has violated these Terms and Conditions or has engaged in unacceptable online behaviour, and the User's account is suspended until that situation is resolved; and
      3. When Home Diagnostics discovers that your activities may be illegal or otherwise unlawful, and therefore prevents your access to the Platform and the Services in general, without prejudice to any actions that Home Diagnostics may take against the User for such breach.
    11. The Service shall be linked to the express acceptance of these Terms and Conditions, as well as the Privacy Policy.

  3. CONDITIONS FOR ACCESS 
    1. Access to and use of the Website is only permitted for persons over 18 years of age. By accepting these Terms and Conditions, the User declares and guarantees to be over 18 years of age, being solely responsible for the veracity of such declaration. 
    2.  The Buyer assumes responsibility for the correct use of the website. This liability shall extend to:
      1. Use this website only to make legally valid enquiries and purchases or acquisitions.
      2. Do not make any false or fraudulent purchases. If it could reasonably be considered that such a purchase has been made, it may be cancelled and the relevant authorities will be notified.
      3. Provide truthful and lawful contact details.
    3. The User expressly acknowledges that the Services are legal in his or her jurisdiction and that by using them he or she does not infringe the applicable regulations in his or her jurisdiction, or in the jurisdiction of the registered members of his or her team.   4. USER ACCOUNT
    1. In order to access all the functionalities of the Platform and the Services, it is necessary for the User to register a User Account on the Website. The creation of an account through the Website implies that it may be used to execute all the functions and tools available on the Platform.
    2. Each individual shall be permitted to register only one User account. In the event that Home Diagnostics becomes aware of the registration of duplicate or multiple unauthorized accounts, Home Diagnostics shall be entitled to delete such accounts, without prejudice to any action that Home Diagnostics may take against such Users under applicable law. The foregoing shall also apply to accounts created by robots or other automated means.
    3. The User declares that at the time of registration or at any time thereafter during the use of the Website and the Platform, he/she will provide only truthful and verifiable information. 
    4. The User represents and warrants that he/she will use his/her legal name and will not use or exploit false identities or identities of other persons or entities without having the necessary authorisation to do so.
    5. The User also declares that he/she will not use usernames and passwords that the User is not authorised to use, or that are vulgar or offensive.
    6. The User agrees to hold Home Diagnostics harmless against any third party for any claims arising from misrepresentations made by the User in connection with the use of the Website and the Platform, including, but not limited to, the identity and age of the User. 
    7. It is the User's responsibility to ensure the secrecy of their Platform access information and to choose a secure password. It is the User's responsibility to exercise due diligence to prevent access or use by third parties accessing or using the identification codes or passwords on their behalf. Likewise, the User shall be responsible for the choice, loss, theft or unauthorised use of any identification code or password and for the consequences that may arise from this. Consequently, the User shall be solely responsible for all activity recorded in your account, unless unauthorised access to your account occurs as a result of Home Diagnostics' fault or lack of diligence. 
    8. Access to the User account is non-transferable. If the User knows or suspects that a third party is accessing his or her User account, he or she must notify Home Diagnostics immediately. Likewise, the User undertakes not to provide his or her User account or the contents of the Platform to any third party.
    9. Home Diagnostics may deny the User access to the Services and functionalities offered through the Website if the User breaches these Terms and Conditions, the applicable regulations and/or makes inappropriate use of the same, all without prejudice to any other actions and rights that Home Diagnostics may have against the User.
  1. PURCHASING PROCESS
      1. Our product information (including descriptions, quantities and prices) does not represent an offer. It is an invitation to make a purchase of our products and services. The purchase transaction will only be completed when your order is accepted. Acceptance of your order is at our discretion and will depend, among other things, on the availability of the products and/or services ordered, the quantities and the availability of stock.
      2. You must follow the online purchase and/or acquisition procedure, during which various products and services can be selected and added to the shopping cart, basket or final shopping space.
      3. Likewise, the Buyer must fill in and/or check the information requested at each step, although, during the purchase process, before making the payment, the purchase details may be modified.
      4. In order to proceed with the purchase, an account must be created where a user name and password chosen by the Buyer must be entered, undertaking to make diligent use of the same, and not to make them available to third parties, as well as to inform the Seller of the loss or theft of the same or of possible access by an unauthorised third party, in such a way that the latter proceeds to block them immediately.

The information to be collected in order to carry out the operation of contracting services and products from Ailin has to do with the invoicing data, shipping address data of the products, and once the payment method has been selected, the introduction of the necessary data to proceed with the payment.
      6. Once the contracting process has been completed, the Buyer will receive an e-mail confirming the order within 24 hours.
      7. The Buyer acknowledges being aware, at the time of purchase, of certain particular conditions of sale concerning the product and/or service in question and which are shown next to the presentation or, where appropriate, the image of the product and/or service on the website, indicating, by way of example, but not exhaustively, and on a case-by-case basis: name, price, components, weight, quantity, colour, details or characteristics of the products, the way in which the services will be provided and their cost. The information provided through the website does not replace the legal publicity of the laws, regulations, plans, general provisions and acts that have to be formally published in the official journals of the public administrations, which are the only instrument that attests to their authenticity and content. The information available on this website should be understood as a guide with no purpose of legal validity.
      8. In accordance with art. 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the steps to follow to complete the purchase process are indicated:
        • Step 1: Access the website: To place an order you need to access the website.
        • Step 2: User/buyer registration: You must register as a user by filling in the electronic form that appears on the website for this purpose and following the instructions indicated therein.
        • Step 3: Filling the shopping basket: To proceed with the purchase of products and services, the Buyer must add the product or service he/she wishes to purchase to the basket, according to the indications shown on the screen. 
          The prices and offers presented on the website are valid only and exclusively for online orders.
        • Step 4: Validate purchase: Fill in the order forms provided for this purpose (Invoicing details, Type of shipment, Delivery details, Payment method and Order) and validate the purchase.
        • Step 5: Payment: Selecting the payment method and making the payment via stripe.
        • Step 6: Confirmation: Once the purchase has been made and as soon as possible, always within 24 hours after the purchase has been made, the Seller will send the BUYER by e-mail a proof of purchase with the characteristics, price, means of transport (if applicable), date of contract and estimated delivery of the product or service contracted. If he does not agree with the data included in this confirmation, he will be able to request the modification of the same or the cancellation of the contract.
      9. All orders received through the website are subject to the availability of the products and services and/or that no cause or circumstance of force majeure affects the supply of the same.
      10. In the event of difficulties in the supply of products or if there are no products in stock, or if there is any type of unavailability of any service, the Seller undertakes to contact the User and reimburse any amount that may have been paid for the purchase or to agree the delivery of the product or the performance of the service on a new date.
      11. In the event of carrying out a subscription process to periodically enjoy our products and services, Users must choose the modality that best suits their needs from among those offered by Home Diagnostics: monthly, quarterly, half-yearly or yearly.

    To subscribe, Users must select this option from each product on the Website, choosing the payment method they prefer (monthly, quarterly, half-yearly or annual). Likewise, they will be able to modify it in the shopping cart, prior to finalising the purchase. Once the process has been completed, Users will be able to manage all the details of their subscription by accessing their account, in the subscriptions section.

    Subscription to Home Diagnostics products will be automatically extended for identical periods, with notice of such renewal being issued and an automatic charge being made to the payment method indicated. Users authorize Home Diagnostics to store their payment methods and automatically charge them the amount corresponding to the product and method of their subscription, until Users cancel their subscription. If your payment is declined, you will be notified to update the information and complete the payment in your account. Users will have a maximum of 3 days to update their subscription or their subscription will be placed on «hold» until the payment method is updated, and will be reactivated under the same conditions to which the User was subscribed.

    Users may cancel their subscription by logging into their account in the subscriptions section of the Website. Users may cancel their subscriptions at any time, but they will only be effective if the following requirements are met:

        • Users must give at least 48 hours' notice prior to the due date for payment of the subscription (to ensure that we can process your cancellation request in time).
        • Users must have received the minimum quantity of kits required for their plan, shown in the table, in order to cancel their subscription. This policy is in place so that people do not take advantage of our discounted prices for one-off purchases.

  2. WARNINGS AND SAFETY
    • Keep this kit out of the reach of children. Only to be used by persons over 18 years of age.
    • Before you start, please make sure that your kit is already activated from your personal ailin.co.uk account or if not, please activate it. 
    • Both your data and the sample must be personal and non-transferable. In the event of evidence of results from third parties, we cannot guarantee delivery of the results.
    • Follow the instructions carefully to collect the sample correctly and avoid errors.
    • Use only the material included in this kit to extract the sample. If it is damaged it must not be used.
    • If you are pregnant, have a bleeding disorder or are taking anticoagulants, consult your doctor before starting.
    • Some drugs or supplements can alter lab results. Do not change your medication without consulting your doctor.
    • Lancets are for single, individual use only. They must not be used on damaged or infected skin. 
    • After the puncture, it is normal to feel local tenderness or the appearance of a small bruise. Consult your doctor if you have any concerns.
    • There is a risk of fainting in connection with any blood collection. If you have fainted before, please consult your doctor before starting. If you do faint, stay seated and keep company. If you get dizzy or feel unwell during the test, stop and consult your doctor.
    • After completion, dispose of all used material in an appropriate place.

  3. PRICE AND PAYMENT
    1. The price of the product and/or service is the price in effect at the date and time of your order and will be displayed next to each product and/or service on the website. We try to ensure that the prices displayed in our shop are accurate.
    2. The prices shown include the legally applicable value added tax (VAT) and are indicated in euros.
    3. Prices may change at any time, but any changes will not affect orders or purchases for which the Buyer has already received an order confirmation.
    4. Under no circumstances will the website automatically add additional costs to the price of a product, but only those that the Buyer has voluntarily and freely selected.

  4. METHODS OF PAYMENT

  5. SHIPPING
    1. The destination of the shipments/services is the Spanish peninsular territory, although the geographical scope of certain services or shipment of products may be modified. 
    2. Except in cases of unforeseen or extraordinary circumstances or, where applicable, due to the personalisation of the products, the goods will be delivered within the period indicated on the website according to the shipping method selected by the Buyer.
    3. If, for any reason attributable to the Seller, the delivery date cannot be met, we will contact the Buyer to inform him of this circumstance, who may choose to go ahead with the purchase by setting a new delivery date or to cancel the order with a full refund of the price paid.
    4. If it is impossible to deliver the product due to the Buyer's absence, the order may be returned to the warehouse. However, the carrier will leave a notice explaining where the order is and how to have it redelivered.
    5. If a Buyer is not going to be at the place of delivery in the agreed time slot, he must contact the Seller to arrange delivery on another day.
    6. The Purchaser is responsible for agreeing with the transport company the date and time of collection of the samples, as well as for complying with the instructions regarding the correct collection of the aforementioned samples in order to guarantee their correct transport and analysis by the collaborating laboratory. 

  6. TECHNICAL SPECIFICATIONS OF THE WEBSITE 
    1. The Website is designed and prepared to operate on a computer system that complies with certain technical specifications. In this regard, the User accepts that the Website has not previously been tested in its network environment, and the User assumes full responsibility for any compatibility problems arising from changes imposed by the User in such network environment.

  7. UNAUTHORISED USES
    1. Users represent and warrant that they will comply with the provisions of these Terms and Conditions at all times, whether in accessing and/or browsing the Website and the Platform. In particular, in addition to the obligations set out in clause 7, and without the following list being absolute, the User is prohibited from:
      1. Use the Website or the Platform in any way that may cause damage, interruptions, inefficiencies or defects in its operation or in your or a third party's devices;

The breach of any of the above obligations by the User may lead to the adoption by Home Diagnostics of the appropriate measures protected by law and in the exercise of its rights or obligations, and may lead to the blocking of the User's access, without this giving rise to any compensation in favour of the User for damages.
    3. In this regard, in the event that Home Diagnostics has reason to believe that a User has engaged in any of the unlawful activities or has engaged in any impermissible uses, Home Diagnostics may, among other things, take the following actions:
      1. Suspend, block, limit, close or terminate your right to use the Website, the Platform and/or the Service.
      2. Block the User's account.
      3. Request information or ask you to change incorrect information you have provided.
      4. Deny access to the Website, the Platform and/or the Service indefinitely.

  8. DURATION AND TERMINATION
    1. These Terms and Conditions shall remain in force for as long as the Website remains operational and accessible to the User. 
    2. Home Diagnostics reserves the right to prevent the User's access to the Website, the Platform and/or the Services, without prior notice, inter alia, for the following reasons:
      1. In the event that the User breaches these Terms and Conditions.
      2. In the event that Home Diagnostics believes or knows, in good faith, that the User is making unlawful and/or illegitimate use of the Website or the Platform or intends to do so.
      3. In the event that Home Diagnostics becomes insolvent and/or bankrupt and is unable to provide the Service, maintain the Website or the Platform and/or any similar situation. 
    3. The fact that Home Diagnostics prevents the User's access to the Website, the Platform and/or the Services on the basis of clause 9.2 shall not give rise to any liability on the part of Home Diagnostics and shall not entitle the User to make any claims against Home Diagnostics.
    4. These Terms and Conditions shall also terminate for the general reasons set forth in the Law and, in particular, for breach by the User of the obligations arising from these Terms and Conditions. In the latter case, Home Diagnostics reserves the right to terminate the relationship created by these Terms and Conditions with the User automatically and without notice.
    5. Similarly, Home Diagnostics may terminate the agreement constituting these Terms and Conditions unilaterally and without just cause.
    6. Termination of the agreement constituted by these Terms and Conditions for any reason shall terminate the User's use of the Website and the Platform. 
    7. Termination shall not entitle the User to compensation of any kind, except for damages that may be caused by fraud or negligence and provided that they are ruled by a court or tribunal.
  9. PROCESSING OF PERSONAL DATA
    1. It is very important to Home Diagnostics that the User is clear about Home Diagnostics' policy regarding the protection of personal data. Therefore, Home Diagnostics takes the utmost precautions when collecting the User's personal and non-personal information. For a clear understanding of the policies applied by Home Diagnostics in handling personal and private information, Home Diagnostics recommends that the User visit the Home Diagnostics Privacy Policy and the Home Diagnostics Cookie Policy.
    2.  Without prejudice to the foregoing, the User is informed that he/she may exercise, insofar as applicable, the rights of access, rectification or deletion, limitation of processing, opposition, portability and to oppose automated individual decisions by sending a communication to the postal address or e-mail address indicated below:

    3. Furthermore, the User is informed that he/she has the right to lodge a complaint with the Spanish Data Protection Agency and/or with the Supervisory Authority of the corresponding Autonomous Community in the event that he/she considers his/her rights have been infringed.
  10. ASSIGNMENT
    1. The parties expressly agree that the User may not assign, transfer or subrogate to third parties, or subcontract with them, the rights and obligations arising from these Terms and Conditions, without the express consent and authorisation of Home Diagnostics. 
    2. Home Diagnostics may at any time assign, transfer or subrogate to and/or subcontract with third parties its rights and obligations under these Terms and Conditions, but this shall not affect the User's rights or Home Diagnostics' obligations under these Terms and Conditions of Use.

  11. REPRESENTATIONS, WARRANTIES AND EXCLUSION OF LIABILITY 
    1. Responsibility for the services offered 
      1. The services offered by Home Diagnostics are of an exclusively informative nature for the Users, and therefore it shall not be understood, under any circumstances, that the recommendations or advice provided by Home Diagnostics replace the criteria of a health professional or the need for an individualised medical consultation in relation to a specific case. 
      2. Home Diagnostics' advice and recommendations are based on the truthfulness and accuracy of the information provided by the User, and Home Diagnostics shall not be liable for the lack of truthfulness, accuracy and completeness of the contents due to the User's failure to provide truthful and accurate information through his or her User Account.
      3. Home Diagnostics cannot be held responsible for inaccurate or misleading results reported as a result of a sample being taken incorrectly or without following the instructions provided.
      4. Home Diagnostics does not prescribe the use of drugs, and limits itself to providing information on healthy habits that can improve the health of Users. The advice and recommendations provided by Home Diagnostics do not constitute medical therapies or treatments nor do they constitute a guarantee of improvement and/or cure of the health and/or health problems of the Users. Consequently, Home Diagnostics is not responsible for the decisions taken by Users based on the information provided through the Website, nor for any damages caused to Users or third parties as a result of actions and/or actions taken on the basis of the information provided.
      5. Under no circumstances should Users use the information offered by Home Diagnostics to self-medicate, since, as we have been reiterating, Home Diagnostics is not a clinical diagnostic service and does not replace the need for an individualised medical consultation regarding a specific case.
      6. The User is responsible for consulting a health professional for any health problem detected by Home Diagnostics or any other health problem not reflected in the Results Report.
    2. Responsibility for the operation of the Platform
      Home Diagnostics assumes no liability for any contingency arising from the use of the Website, the Platform, or any other elements of the Service.

      Furthermore, Home Diagnostics shall in no event be liable for:

      1. The lack of availability or accessibility of the Website or the Platform;
      2. The interruption in the operation of the Website or the Platform or the existence of computer failures, telephone breakdowns, disconnections, delays or blockages caused by deficiencies or overloads in the telephone lines, data centres, in the Internet system or in other electronic systems, produced in the course of its operation;
      3. Errors or delays in accessing the Website or the Platform by the User when entering their data in the form, slowness or any anomaly that may arise when these incidents are due to problems in the internet network, fortuitous events or force majeure and any other unforeseeable contingency beyond the good faith of Home Diagnostics;
      4. Loss, damage or harm of any kind arising from accessing and making use of the Website or the Platform, including but not limited to that caused to computer systems or caused by the introduction of viruses and/or computer attacks;
      5. The accuracy, completeness or up-to-dateness of information that is not produced by the company itself;
      6. Differences or inaccuracies that may exist on the Website or on the Platform due to the lack of screen resolution of the mobile device or problems with the browser being used or others of this nature;
      7. Technical failures which, due to unforeseen circumstances or otherwise, prevent the normal operation of the service via the Internet. 
      8. Other damages that may be caused by third parties through unauthorised interference beyond the control of Home Diagnostics.
    3. The User is solely responsible for the proper functioning of their own systems, and must prevent them from altering the information or data stored in the products, services and systems of Home Diagnostics. The User shall be liable to Home Diagnostics and to third parties in the event of anomalies or losses in such data and/or information attributable to the User.
    4. Home Diagnostics is not responsible for the malfunctioning of the electronic communications services through which it provides the Service and access to the Website and the Platform.
    5. Furthermore, the User undertakes not to take any action that causes disproportionate or unnecessary saturation of the infrastructure of the Website, the Platform and/or the Services or the systems or networks of Home Diagnostics, as well as the systems and networks connected to the Website and the Platform.
    6. The User undertakes not to impede the normal development of the Website, the Platform or any of its functionalities, by any procedure, and/or through any practice that violates or infringes in any way these Terms and Conditions, and Home Diagnostics may terminate the contractual relationship with the User if it does not do so, without prejudice to any actions it may take in exercise of its legitimate rights in accordance with the legal system in force.
    7. Home Diagnostics may, at any time, establish security measures and guidelines for the User's access to and use of the Website and the Platform. Such security guidelines must at all times be complied with by the User, otherwise Home Diagnostics shall be entitled to prevent the User from accessing the Website and/or the Platform.
    8. The User guarantees to know and comply at all times, in relation to the Services available on the Website and the Platform, with the applicable legislation, in such a way that they are in accordance with the law, morality and public order, exempting Home Diagnostics from any liability in this regard.
    9.  Home Diagnostics will use its best efforts to ensure that the Service, the Website and the Platform do not contain, and are not used for the transmission, installation or publication of, any viruses, malicious code or other harmful programs or files, or in any way that may cause damage, interruptions, inefficiencies or defects in its operation or in any third party's devices. However, Home Diagnostics does not warrant and shall not be liable for: (i) the invulnerability of the Website, the Platform and/or the impregnability of the security measures adopted therein; (ii) the lack of utility or performance of the Website and/or the Platform; (iii) failures of the Website and/or the Platform caused by any kind of attack on the servers of Home Diagnostics' third party service providers, as well as technical or system security failures of any such providers that prevent the operation of the Website and/or the Platform; (iv) any technical failure of any kind that hinders, delays or prevents the proper functioning of the Website and/or the Platform; and (v) any damage or harm caused, either to yourself or to a third party, by any person who violates these Terms and Conditions of Use, rules and instructions set out on the Website and/or the Platform or through the violation of the security systems of the Website and/or the Platform.
    10. Nevertheless, Home Diagnostics declares that it has adopted all the necessary measures, within its possibilities and the state of the art, to guarantee the functioning of the Website, the Platform and the Service, as well as to avoid the existence and transmission of viruses and other harmful components.
    11. If the User becomes aware of the existence of any content that is illicit, illegal, contrary to the law or that could involve an infringement of intellectual and/or industrial property rights, or of any other third party rights, he/she must notify Home Diagnostics immediately by e-mail sent to info@ailin.es so that the appropriate measures can be taken.
    12. The User guarantees that he/she will comply with all the commitments he/she assumes and will hold Home Diagnostics harmless against any judicial or extrajudicial claim from third parties for any reason related to the rights and obligations arising from these Terms and Conditions.
    13. The Website and the Platform are provided «as is» without warranties of any kind, express or implied. Use of this Website, the Platform and any Services offered by Home Diagnostics is at the User's own risk.
    14. Home Diagnostics shall not be liable to the User or to any third party, whether directly or indirectly, for any indirect and/or incidental damages of whatever nature or concept arising out of these Terms and Conditions or in connection with the Website, the Platform and/or any products or services offered by Home Diagnostics.
    15. The Website and the Platform may contain technical inaccuracies and typographical errors. Home Diagnostics assumes no responsibility or liability for any such inaccuracies, errors or omissions, and shall have no obligation to honor any information affected by such inaccuracies. Home Diagnostics reserves the right to make changes, corrections, cancellations and/or improvements to any information contained on the Website and the Platform, and to the products and programs described in such information, at any time and without notice, including after confirmation of a transaction.
    16. The User agrees to hold harmless, indemnify, hold harmless and defend without limitation Home Diagnostics, its affiliates, directors, shareholders, officers, licensees, employees and agents against any and all legal claims, charges, damages, costs, expenses, liabilities and losses, including reasonable attorneys' fees, arising out of the User's use of the Services, the Website, the Platform and uploaded content and/or breach of any of the obligations contained in these Terms and Conditions. 
    17. In any case, Home Diagnostics reserves the right to exercise all the actions that correspond to it, as well as to suspend, modify, restrict or interrupt, either temporarily or permanently, the access, navigation, use, hosting and/or downloading of the content and/or use of the Website and the Platform, with or without prior notice, to Users who contravene any of the provisions detailed in these Terms and Conditions of Use, without the possibility of the User being able to demand any compensation for this cause.
    18. Home Diagnostics shall not be liable in any way, to any person or entity, for any damages allegedly caused by the use or non-use of the Website or the Platform, either directly or indirectly, for malfunctions or damages caused by force majeure or events beyond the control of Home Diagnostics, or for any failure to comply with the obligations of any user, including but not limited to: the good condition of the computer system and the electrical supply installation, the control of access to the Website and the Platform in order to avoid manipulation by unauthorised or inexperienced persons, the contracting of periodic hardware and software maintenance services, the prevention of viruses and defective programs installed on the same hard disk, work interruptions, as well as any other reasonably applicable preventive measures.

  12. RETURNS
    1. You have the right to withdraw from the contract within 14 calendar days without giving any reason. Such withdrawal must be notified to the Seller in writing to the electronic contact details mentioned at the beginning of these General Terms and Conditions. 
    2. The Buyer, irrespective of the means he chooses to exercise his right of withdrawal, must clearly and unequivocally state that he intends to withdraw from the purchase contract.
    3. The withdrawal period shall expire 14 calendar days after the day on which the Buyer or a third party authorised by the Buyer, other than the carrier, acquires material possession of the goods purchased on our website or, in the event that the goods making up the order are delivered separately, 14 calendar days after the day on which the Buyer or a third party authorised by the Buyer, other than the carrier, acquires material possession of the last of those goods making up the same purchase order.
    4. In order to comply with the withdrawal period, it is sufficient that the communication unequivocally expressing the decision to withdraw is sent before the expiry of the withdrawal period.
    5. Notwithstanding the foregoing, in accordance with the provisions of Article 103 of the General Law for the Defence of Consumers and Users, with regard to the provision of services, e.g. interpretation of the results of diagnostic tests at home, the right of withdrawal may not be exercised once the service has been fully performed or when performance has begun, with the prior express consent of the Buyer and with the Buyer's acknowledgement that he is aware that, once the contract has been fully performed by the entrepreneur, he will have lost his right of withdrawal.
    6. In addition, the right of withdrawal may not be exercised if the goods are likely to deteriorate or expire quickly, as well as if the products are sealed and are not suitable for return for reasons of health protection or hygiene once they have been unsealed after delivery.
    7. In case of exercising the right of withdrawal, you will be refunded the amount paid including transport costs, provided that the product is in the same condition in which it was delivered. The costs of returning the product shall be borne by the customer, who will be deducted the amount of the final return. 
    8. The reimbursement shall be made without undue delay and in any event not later than 14 calendar days from the date on which the Seller is informed of the exercise of his right of withdrawal.
    9. However, such reimbursement may be withheld by the Seller until the Seller has received the products or items from the Buyer, or until the Buyer provides proof of return of the products or items, whichever condition is met first.
    10. The refund will be made by the same payment method used by the Buyer for the initial purchase transaction.
    11. The Buyer must return the products or goods subject to withdrawal, also within 14 calendar days from the date on which he notified his right of withdrawal.
    12. The Buyer acknowledges being aware that he shall bear the direct cost of the return (transport, delivery) of the goods, should any be incurred. In addition, he shall be liable for any diminished value of the products resulting from handling other than that set out in the product instructions.
    13. Therefore, the product must be returned using or including all its original packaging, instructions and other accompanying documents, as well as a copy of the purchase invoice.
    14. In the case of the provision of services where the Buyer exercises his right of withdrawal during the provision of the service, the Seller shall be paid an amount proportional to the part of the service already provided at the time when the Buyer has informed the Seller of the exercise of the right of withdrawal, in relation to the total subject matter of the contract. In these cases the proportional amount to be paid by the Buyer is calculated on the basis of the total price agreed in the contract.

  13. RETURN OF DEFECTIVE PRODUCTS OR DELIVERY ERROR
    1. If the Buyer considers that, at the time of delivery, the product does not conform to the stipulations of the contract or purchase order because it is a defective product or because there is an error in the shipment of the product, he must contact the Seller immediately and make his disagreement (defect/error) known through the contact details established at the beginning of these General Contracting Conditions.
    2. The Buyer will then be informed on how to proceed with the return of the products and, once returned, the products will be examined and the Buyer will be informed, within a reasonable period of time, whether a refund or, if necessary, a replacement is appropriate.
    3. The amount paid for those products that are returned because of a defect, when it really exists, will be refunded in full, including shipping costs and the costs that the Buyer may have incurred to make the return. The refund will be made by the same payment method that the Buyer used to make the purchase.

  14. GUARANTEES
    1. The Buyer, as a consumer and user, enjoys guarantees on the products that can be purchased through this website, in the terms legally established for each type of product in the Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.
    2. In this sense, the products are deemed to be in conformity with the contract provided that:
      • Conform to the description made by the Seller and possess the qualities presented on the website.
      • are suitable for uses for which products of the same type are normally intended.
      • They are of a quality and performance which is normal for a product of the same type and which is essentially to be expected of a product of the same type.
    3. If this is not the case for the products delivered to the Buyer, the Buyer must proceed as indicated in the section “Return of defective products or delivery errors”.
    4. However, some of the products marketed on the website may have non-homogeneous characteristics, provided that these derive from the type of material from which they are made, and therefore form part of the individual appearance of the product, and are not a defect.
    5. On the other hand, the Buyer purchases products manufactured by third parties on the website, so you have the possibility to contact the brand or the manufacturer of the product directly to find out how to exercise your rights.
    6. Whoever the warranty claim is made to, the Buyer must have retained all information relating to the warranty of the products (invoice and warranty).

  15. COMPLAINTS
    1. Users who wish to submit a complaint to Home Diagnostics may do so by sending their complaint or query to the e-mail address info@ailin.es.

  16. MISCELLANEOUS
    1. Home Diagnostics will prosecute any breach of these Terms and Conditions, as well as any improper use of its Website, the Platform and/or its Service, exercising all civil and criminal actions to which it may be entitled by law. The communications, purchase and payment orders that intervene during the transactions carried out on the Website may be filed and kept in the computerised records of the Seller in order to constitute a means of proof of the transactions, respecting the reasonable conditions of security and the laws and regulations in force that are applicable in this respect and, specifically, in accordance with Organic Law 3/2018, of 5 December, on Personal Data Protection and guarantee of digital rights, Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce and Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.
    2. The failure of Home Diagnostics to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision nor, if any, relieve the User from the performance of its obligations, unless expressly acknowledged and agreed to in writing by Home Diagnostics.
    3. Home Diagnostics may modify these Terms and Conditions at any time, in which case the new version will be duly published. The version of the Terms and Conditions in force shall be the one published at the time.
    4. If one of the provisions of these Terms and Conditions should be declared null and void or unenforceable by the Public Administration or the Administration of Justice, the rest of the Terms and Conditions shall remain in the agreed terms. Home Diagnostics undertakes to replace the provision affected by the invalidity as closely as possible to the original intention. 
    5. These Terms and Conditions, the Privacy Policy and the Cookie Policy constitute the entirety of the documents and agreements entered into between Home Diagnostics and the User and supersede any prior agreements and/or documents of a contractual nature. 

  17. APPLICABLE LAW AND JURISDICTION 
    1. These Terms and Conditions are governed by Spanish law. Any dispute shall be subject to the exclusive jurisdiction of the Courts and Tribunals of the User's domicile.
    2. In cases where the applicable legislation so permits, the parties, expressly waiving their own jurisdiction, agree to submit any conflict or dispute to the exclusive jurisdiction of the Judges and Courts of Madrid (Capital).
    3. EU Citizen Users will also have at any time the possibility to use the European Commission's online dispute resolution platform which can be accessed through this link.
